طالب خبيران حقوقيان إسرائيل بالتوقف الفوري عن عمليات هدم المنازل والممتلكات الفلسطينية والامتثال لالتزاماتها الإنسانية الدولية وحقوق الإنسان، وتوفير الحماية للسكان بدلا من تهجيرهم.

وفي بيان صدر عن مايكل لينك المقرر* الخاص المعني بوضع حقوق الإنسان في الأرض الفلسطينية المحتلة منذ عام 1967، وبالاكريشنان راجاجوبال، مقرر الأمم المتحدة الخاص المعني بالسكن اللائق، أدان الخبيران هدم إسرائيل للمنازل والممتلكات التي تعود لمجتمع بدوي فلسطيني في شمال غور الأردن بالضفة الغربية في بداية هذا الشهر، وسط ارتفاع كبير في عمليات هدم الممتلكات في جميع أنحاء الأرض المحتلة.
وقال الخبيران: "إن نظام التخطيط الإسرائيلي في الأرض المحتلة تمييزي ومُقيّد، ونادرا ما يمنح الفلسطينيين طلبات الحصول على تصاريح البناء. ينتج عن ذلك مناخ قسري، حيث تؤدي عمليات هدم الممتلكات أو التهديد بالهدم إلى إبعاد الفلسطينيين عن منازلهم وأراضيهم وسبل عيشهم".
وأعرب الخبيران عن قلق خاص إزاء نمط تصاعد عمليات هدم المنازل والممتلكات من قبل إسرائيل أثناء جائحة كـوفيد-19.
وقالا في البيان: "السكن الآمن هو أحد أشكال الحماية المطلقة التي يمتلكها الأفراد لحماية أنفسهم من كوفيد-19. إن التسبب عمدا في تشرّد السكان في خضّم كارثة صحية دولية هو اختلال خطير في حقوق الإنسان تتحمله أي سلطة حكومية مسؤولة عن مثل هذه الأفعال".
¤أكبر عمليات هدم منذ عقد¤
في بداية تشرين الثاني/نوفمبر، تم تشريد 73 فردا من سكان خربة حمصة، بينهم 41 طفلا، وتم هدم أكثر من 75 مبنى ومُنشأ بما في ذلك خيام وحظائر حيوانات وألواح شمسية. ومن حيث عدد الأشخاص الذين تُركوا بلا مأوى، فإن تدمير خربة حمصة هو أكبر عملية هدم فردية تنفذها الإدارة المدنية الإسرائيلية منذ عام 2010.

وقالت الإدارة المدنية الإسرائيلية إنه تم تدمير تلك المنشآت لأنها أقيمت بشكل غير قانوني في موقع للرماية العسكرية.
لكن، بحسب الخبيرين الحقوقيين، تهدم السلطة القائمة بالاحتلال بشكل روتيني المباني والمنازل الفلسطينية التي بُنيت بدون تصريح في الضفة الغربية والقدس الشرقية. وأشارا إلى أن الجيش الإسرائيلي صادر أجزاء كبيرة من الضفة الغربية واستخدمها كمناطق للرماية العسكرية، مما أثّر على أراضي وحياة العديد من المجتمعات الرعوية والدائمة.
☆☆869 فلسطينيا بلا مأوى في 2020☆☆
وفقا لمكتب الأمم المتحدة لتنسيق الشؤون الإنسانية (أوتشا)، أصبح 869 فلسطينيا بلا مأوى هذا العام بسبب تدمير إسرائيل للممتلكات، وهو أكبر عدد منذ عام 2016.
وقال الخبيران: "إن عمليات هدم المنازل والممتلكات الخاصة بسكان محميين تحت الاحتلال من قبل قوة احتلال، هي انتهاك خطير لاتفاقية جنيف الرابعة". وبحسب المادة 53 من الاتفاقية، يُحظر على السلطة القائمة بالاحتلال تدمير الممتلكات العقارية والشخصية ما لم تكن "ضرورية للغاية خلال العمليات العسكرية".

Two human rights experts called on Israel to immediately halt the demolition of Palestinian homes and properties, to comply with its international humanitarian and human rights obligations, and to provide protection for the population instead of displacing them.

In a statement issued by Michael Link, the Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967, and Palakrishnan Rajagopal, the United Nations special rapporteur on adequate housing, the two experts condemned the Israeli demolition of homes and properties belonging to a Palestinian Bedouin community in the northern Jordan Valley in the West Bank in Beginning this month, amid a significant rise in property demolitions across the occupied territories.
The experts said, "The Israeli planning system in the Occupied Territories is discriminatory and restrictive, and it rarely gives Palestinians applications for building permits. This results in a coercive climate, where property demolitions or threats of demolition lead to the removal of Palestinians from their homes, lands and livelihoods."
The two experts expressed particular concern about the pattern of escalating home and property demolitions by Israel during the COVID-19 pandemic.
They said in the statement: “Safe housing is one of the forms of absolute protection that individuals possess to protect themselves from Covid-19. Deliberately causing displacement of a population in the midst of an international health disaster is a serious human rights imbalance that any governmental authority responsible for such acts bears.”
The 'largest demolitions in a decade'
At the beginning of November, 73 residents of Khirbet Humsa, including 41 children, were displaced, and more than 75 buildings and structures were demolished, including tents, animal barns, and solar panels. In terms of the number of people left homeless, the destruction of Khirbet Humsa is the largest single demolition carried out by the Israeli Civil Administration since 2010.

The Israeli Civil Administration said that these facilities were destroyed because they were established illegally at a military firing site.
However, according to the two human rights experts, the occupying power routinely demolishes Palestinian buildings and homes that were built without a permit in the West Bank and East Jerusalem. They pointed out that the Israeli army confiscated large parts of the West Bank and used them as military firing zones, which affected the lands and lives of many pastoral and permanent communities.
869 Palestinians homeless in 2020 ☆☆
According to the United Nations Office for the Coordination of Humanitarian Affairs (OCHA), 869 Palestinians became homeless this year due to Israel's destruction of property, the largest number since 2016.
The two experts said, "The demolitions of homes and properties belonging to residents protected under occupation by an occupying power are a serious violation of the Fourth Geneva Convention." According to Article 53 of the Convention, the occupying power is prohibited from destroying real and personal property unless it is "absolutely necessary during military operations".
